Terms of Service

1. Agreement to Terms

By accessing or using ResumeEnhance ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

2. Account Terms

• You must be at least 18 years old to use this Service.
• You must provide a valid email address and any other required information to complete the signup process.
• You are responsible for maintaining the security of your account and password. ResumeEnhance cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• You are responsible for all content posted and activity that occurs under your account.
• You may not use the Service for any illegal or unauthorized purpose.
• You must not, in the use of the Service, violate any laws in your jurisdiction.
• One person or legal entity may not maintain more than one free account.

3. Payment and Billing

• A valid payment method is required to process payment for any paid subscription.
• You will be charged in advance on a recurring and periodic basis (monthly or annually, depending on your plan).
• At the end of each billing period, your subscription will automatically renew unless you cancel it or ResumeEnhance cancels it.
• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities.
• Refunds are handled on a case-by-case basis. Please contact our support team to discuss your specific situation.
• We reserve the right to modify our pricing at any time. Price changes will not affect current subscribers until their next renewal period.

4. Cancellation and Termination

Cancellation by You: You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation will be effective at the end of your current billing period. You will not receive a refund for any fees already paid for your current subscription period.

Termination by Us: We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Intellectual Property and Content Rights

Service Ownership: The Service, including but not limited to its "look and feel" (e.g., text, graphics, images, logos), proprietary content, information and other materials, are protected under copyright, trademark, and other intellectual property laws. You agree that ResumeEnhance and/or its licensors own all right, title and interest in and to the Service (including any and all intellectual property rights therein) and you agree not to take any action(s) inconsistent with such ownership interests.

Your Content: You retain ownership of the resumes, cover letters, and other career materials you upload or create ("User Content"). By submitting User Content to the Service, you grant ResumeEnhance a worldwide, non-exclusive, royalty-free, fully paid right and license to host, store, transfer, display, perform, reproduce, modify for the purpose of formatting for display, and distribute your User Content, in whole or in part, in any media formats and through any media channels now known or hereafter developed.

Data Usage: You agree that ResumeEnhance may collect, use, and share aggregated, anonymized data derived from your User Content and usage of the Service for any business purpose, including to improve our AI models, algorithms, and Service functionality, provided that such data does not personally identify you.

AI Output: Subject to your compliance with these Terms, ResumeEnhance hereby assigns to you all its right, title, and interest in and to the output generated by the AI services based on your User Content.

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable national or international law or regulation.
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
• Submit false or misleading information.
• Upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.
• Attempt to reverse engineer, decompile, disassemble, or derive source code, underlying ideas, algorithms, structure, or organization of the Service or the AI models.
• Engage in any "prompt injection" attacks or other attempts to manipulate the AI to generate harmful, illegal, or unintended output.
• Use the Service to build a competitive product or service, or copy any features, functions, or graphics of the Service.
• Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Service.

7. Disclaimers and Limitations of Liability

NO WARRANTIES: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

NO GUARANTEE OF RESULTS: RESUMEMASTER IS A TOOL TO ASSIST IN RESUME CREATION. WE DO NOT GUARANTEE THAT USE OF OUR SERVICE WILL RESULT IN JOB INTERVIEWS, JOB OFFERS, EMPLOYMENT, OR ANY SPECIFIC CAREER OUTCOME. HIRING DECISIONS ARE SOLELY AT THE DISCRETION OF THIRD-PARTY EMPLOYERS.

USER RESPONSIBILITY: YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, VERIFYING, AND EDITING ALL CONTENT GENERATED BY THE SERVICE BEFORE SUBMITTING IT TO ANY EMPLOYER OR THIRD PARTY. WE DISCLAIM ALL LIABILITY FOR ANY ERRORS, OMISSIONS, OR MISREPRESENTATIONS IN YOUR RESUME OR COVER LETTER, WHETHER GENERATED BY AI OR NOT.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RESUMEMASTER (AND ITS OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• ANY CONTENT OBTAINED FROM THE SERVICE; AND
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO RESUMEMASTER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).

8. Indemnification

You agree to defend, indemnify, and hold harmless ResumeEnhance and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. We take data security seriously but cannot guarantee absolute security of your data.

10. Changes to Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

We reserve the right to update these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be finally settled by binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in English and the award shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and ResumeEnhance regarding the Service.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
• Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
