1. Agreement to Terms

By accessing or using ResumeEnhance ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

2. Account Terms

• You must be at least 18 years old to use this Service.
• You must provide a valid email address and any other required information to complete the signup process.
• You are responsible for maintaining the security of your account and password. ResumeEnhance cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• You are responsible for all content posted and activity that occurs under your account.
• You may not use the Service for any illegal or unauthorized purpose.
• You must not, in the use of the Service, violate any laws in your jurisdiction.
• One person or legal entity may not maintain more than one free account.

3. Payment and Billing

• A valid payment method is required to process payment for any paid subscription.
• You will be charged in advance on a recurring and periodic basis (monthly or annually, depending on your plan).
• At the end of each billing period, your subscription will automatically renew unless you cancel it or ResumeEnhance cancels it.
• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities.
• Refunds are handled on a case-by-case basis. Please contact our support team to discuss your specific situation.
• We reserve the right to modify our pricing at any time. Price changes will not affect current subscribers until their next renewal period.

4. Cancellation and Termination

Your Rights: You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, you will continue to have access to paid features until the end of your current billing period.

Our Rights: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users, third parties, or our business interests
• Involves fraudulent or illegal activity
• Abuses our AI resources or attempts to reverse-engineer our technology

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Intellectual Property and Content Ownership

Platform Ownership: The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of ResumeEnhance and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

Your Content: You retain all rights to the content you upload to ResumeEnhance (including resumes and job descriptions). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and analyze your content solely for the purpose of providing and improving the Service.

AI-Generated Content: Content generated by our AI tools based on your input is provided to you under a license for your personal and commercial use. However, you acknowledge that similar content may be generated for other users based on similar inputs.

6. Acceptable Use Policy

You agree not to:

• Use the Service to create false, misleading, or fraudulent resumes
• Upload viruses, malware, or any malicious code
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any copyright, trademark, or proprietary notices
• Use the Service to compete with ResumeEnhance or develop a competing product
• Share your account credentials with others or sell access to the Service
• Abuse our AI resources through excessive or improper usage

7. Disclaimers and Limitations of Liability

NO WARRANTIES: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NO GUARANTEE OF RESULTS: While ResumeEnhance uses advanced AI technology to enhance resumes, we do not guarantee that use of our Service will result in job interviews, job offers, or employment. Career success depends on numerous factors beyond our control.

AI ACCURACY: Our AI-powered tools provide suggestions and enhancements, but may not always be 100% accurate or appropriate for your specific situation. You are responsible for reviewing and verifying all AI-generated content before using it.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUMEENHANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO RESUMEENHANCE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8. Indemnification

You agree to defend, indemnify, and hold harmless ResumeEnhance, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to your user content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. We take data security seriously but cannot guarantee absolute security of your data.

10. Changes to Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

We reserve the right to update these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be finally settled by binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in English and the award shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and ResumeEnhance regarding the Service.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
• Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
